San Diego woman will not face charges in bank crash which killed boy
Wednesday April 16, 2003SAN DIEGO (AP) Prosecutors will not file criminal charges against a San Diego County woman who killed an 8-year-old boy and injured two adults when she drove her sport utility vehicle into the front of a bank two months ago, San Diego City Attorney Casey Gwinn said Wednesday.
Gwinn said in a statement there was insufficient evidence to prove beyond a reasonable doubt that Parivash Rahnamai was guilty of vehicular manslaughter.
On Feb. 17, Rahnamai drove her SUV onto a sidewalk outside a bank in the Rancho Penasquitos neighborhood. Anthony Remos of San Diego was walking with his father when he was struck and fatally injured. The boy's father and a woman also were injured.
Rahnamai, 55, told police she could not explain what happened. She said she might have had her foot caught on the accelerator as she pulled into the bank parking lot, or forgot to turn off the engine and take the vehicle out of gear before releasing the brake.
The statement from Gwinn's office said that in deciding not to file charges, investigators reviewed the San Diego Police report, witness testimony and the bank's surveillance tape showing the accident.
``The City Attorney acknowledges this is a tragic accident and has great sympathy for the Remos family,'' the statement said.
