Judge declares mistrial in case against Marion ``Suge'' Knight associate

TORRANCE, Calif. (AP) A judge declared a mistrial Thursday in the murder and assault case against an associate of rap music mogul Marion ``Suge'' Knight after jurors could not reach a verdict.

Jurors deliberated for three days but could not reach a decision for Timothy McDonald, 34, prompting Superior Court Judge Laura Ellison to end the trial.

McDonald, who worked for Knight's record label, remained in custody on $500,000 bail pending a Nov. 10 hearing. Defense attorney Anthony Brooklier said he would request the case be dropped. It was not immediately known if prosecutors would refile charges against McDonald.

McDonald allegedly pointed a gun through a car window at a man in South Los Angeles last October before he was stopped by a Los Angeles County sheriff's deputy. No shots were ever fired.

Brooklier called into question the deputy's account and said the intended victims were never identified by authorities.
